Please read carefully before participating in any Hybrid Kinetics programs, classes, or content (or “Activity(ies)”). By creating an account, accessing our app/website, or participating in any Hybrid Kinetics Activities, you acknowledge and agree to the following terms:
1. Acknowledgment of Risks
I understand that engaging in any fitness activity — including but not limited to Pilates, corrective exercise, strength training, HIIT, mobility, and performance training — involves inherent risks. I take full responsibility and assume all risks related to or arising out of my participation in any content, event, or program provided by or on behalf of Hybrid Kinetics, including workouts completed live, on-demand, or independently.
2. Release of Liability
In consideration for access to Hybrid Kinetics content and programs, I hereby agree to irrevocably waive and release Hybrid Kinetics, its owners, directors, trainers, instructors, employees, contractors, agents, and affiliates (“Released Parties”) from any liability, claims, or causes of action for bodily injury, illness, disability, death, property damage, or emotional distress that is caused, whether directly or indirectly, by any of the Released Parties that relates to or arises out of my participation in a Hybrid Kinetic content, event, or program. This waiver applies to any claims made during or after participation in a Hybrid Kinetic Activity.
I further understand that in signing this Agreement, I surrender my right to make a claim or file a lawsuit against a Released Party for personal injury, property damage, wrongful death, products liability or under any other theory, to the maximum extent allowed by law.
3. Indemnification
I agree to indemnify and hold harmless each Released Party from any loss, liability, damages, costs (including reasonable attorneys’ fees) or expenses incurred in defending any claim made by me or anyone making a claim on my behalf in connection with my participation in a Hybrid Kinetic content, event, or program.
4. Health Disclaimer
The information and guidance provided by Hybrid Kinetics is for informational purposes only and is not a substitute for professional medical advice or treatment. It is recommended to consult a physician before beginning any fitness program, especially if you have pre-existing health conditions or concerns.
I confirm that I am in good health and am physically and mentally able to participate in a fitness program or otherwise exercise. I have consulted with a physician or chosen to participate at my own risk without such consultation. I agree to stop any Hybrid Kinetics Activities immediately if I feel pain, dizziness, or discomfort and to seek medical advice if needed.
5. Participant Responsibility
I agree to follow all instructions and guidelines provided in the app, on the website, or during live sessions.
I acknowledge I am responsible for creating a safe workout environment, including adequate space, proper equipment setup, and minimizing hazards in my surroundings.
I agree not to share my login credentials with others.
6. Hybrid Kinetics Commitment
Our trainers and instructors will provide clear, form-focused instruction within their professional scope of practice.
Content and programming will be designed for safe, progressive training, but cannot and will not replace individualized medical advice.
Any personal information provided will be kept confidential.
7. Payments, Subscriptions & Cancellations
I understand that all subscriptions, memberships, and digital purchases are non-refundable unless otherwise stated.
I may cancel my membership/subscription at any time through my account settings; however I understand that access will remain until the end of the current billing cycle.
I understand and acknowledge that Hybrid Kinetics reserves the right to modify these terms of use including any pricing, content, programming, or membership/subscription terms at its sole discretion with notice.
8. Media Release
I consent to the reproduction and use by Hybrid Kinetics of photographs, videos and other images and sound recordings of me without compensation, for advertising or other purposes in any and all media now existing or hereafter developed. I release the Released Parties from liability for any violation of any personal and/or proprietary right I may have in connection with such reproduction or use.
9. Digital Acceptance
By checking the box below or creating an account, I confirm that I have read and understand this agreement, and I voluntarily accept and assume all risks. I understand that this agreement is legally binding and that by electronically accepting, I waive substantial legal rights. I further understand that the agreements of release and indemnity contained herein include loss, damage or expense claimed to have been caused in whole or in part by the negligence of a Released Party, but not gross negligence or intentionally wrongful conduct.
I am at least 18 years of age and have full legal capacity to consent to this Agreement. Of importance, if you are under the age of 18, you may only participate with the consent of a parent or legal guardian, who must sign on your behalf.
